General Contest Rules
These rules apply to all contests operated by HIGH
GEAR MOTORCYCLE SERVICES LTD. Either online or otherwise including on
www.2coolforschool.ca (the “Website”) and where you can enter or participate
in a HIGH GEAR MOTORCYCLE SERVICES LTD. branded contest or giveaway via
Facebook, Twitter or any other third party service or site (a “Third Party
Service”), except where there are specific rules for a particular contest (a
“HIGH GEAR MOTORCYCLE SERVICES LTD. contest”).
By entering a HIGH GEAR MOTORCYCLE SERVICES LTD.
contest, you agree to be bound by these Contest Rules.
Details of the prize(s) available to be won, the
start and end dates and/or times, and any other information relevant to
entering, participating or winning will be identified on the Website, via the
Third Party Service and/or by poster/flier, or such other medium, as
applicable, for each HIGH GEAR MOTORCYCLE SERVICES LTD. Contest.
Unless otherwise stated for any HIGH GEAR MOTORCYCLE
SERVICES LTD. contest, there is a limit of one entry per person.
Unless otherwise stated, HIGH GEAR MOTORCYCLE
SERVICES LTD. contests are open to all Canadian residents who have reached
the age of majority in their province or territory of residence. If the
contest is open to minors, for any contestant who has not reached the age of
majority, parent or guardian consent is necessary to enter a HIGH GEAR
MOTORCYCLE SERVICES LTD. contest. Where appropriate, the terms “contestant”
and “winner” mean parent or guardian of that person.
Employees of HIGH GEAR MOTORCYCLE SERVICES LTD. ,
such employees’ immediate family (father/mother, brother/sister,
son/daughter) or persons living under the same roof are not eligible to enter
any HIGH GEAR MOTORCYCLE SERVICES LTD. contest.
To enter for a chance to win a HIGH GEAR MOTORCYCLE
SERVICES LTD. contest, follow the instructions given on the Website, via the
Third Party Service, or as otherwise instructed to find out how to enter and
win a prize.
For contests where the winner is selected by a draw,
a random draw will be made by a HIGH GEAR MOTORCYCLE SERVICES LTD. representative
from all qualifying entries made by the contest deadline. Selected contestant(s)
will be contacted using the contact information provided at the time of entry
(eg. telephone number, email address, twitter handle, Facebook account, etc).
If a selected contestant cannot be reached or qualified using the information
provided at the time of entry within three business days (or such other time
as notified on the Website or on-air), incorrectly answers the mathematical
skill testing question (where required), declines the prize, or fails to
return any required release form, the prize shall be forfeited and HIGH GEAR
MOTORCYCLE SERVICES LTD. has the right, at its sole discretion, to
select another winner.
For HIGH GEAR MOTORCYCLE SERVICES LTD. contests,
Twitter giveaways or any other HIGH GEAR MOTORCYCLE SERVICES LTD. contest where
the winner is responsible for picking up the prize, the prize must be picked
up within 30 days or it shall be forfeited and HIGH GEAR MOTORCYCLE SERVICES
LTD. has the right, at its sole discretion, to select another winner.
To be declared a winner, the selected contestant
must first correctly answer a mathematical skill-testing question, where
applicable. Potential winners may be required to furnish proof of
identification. Winner(s) may also be required to sign a release declaring
their eligibility as stipulated in these rules; and releasing HIGH GEAR
MOTORCYCLE SERVICES LTD. any sponsor or prize donor and their directors,
officers and employees (the “Contest Parties”) from all liability for any
damage or loss arising from participation in the contest or from the
awarding, acceptance or use of the prize.
Prizes shall be accepted as is and may not be
exchanged or refunded for an amount of money, sold or transferred. No
substitutions will be allowed. Any unused portion of a prize will be
forfeited.
If the prize cannot be awarded as described in these
rules, or the specific rules of a given contest, HIGH GEAR MOTORCYCLE
SERVICES LTD. reserves the right to substitute a prize or prize
component with another of comparable value, as determined in its sole
discretion.
Refusal to accept the prize releases the Contest
Parties from any obligation toward the winner.
If a contestant makes any false statement, (s)he
will be automatically disqualified from the Contest.
Winners agree that HIGH GEAR MOTORCYCLE SERVICES
LTD. may use their name, image and/or voice for advertising purposes related
to a HIGH GEAR MOTORCYCLE SERVICES LTD. contest, free of charge.
The Contest Parties assume no liability for any
loss, damage or injury, including without limitation:
(i) lost, stolen, delayed,
damaged, misdirected, late, destroyed, illegible or incomplete entries;
(ii) loss, theft or damage to
software or computer or telephone data, including any breach of privacy;
(iii) fraudulent calls;
(iv) inability of any person to
participate in the Contest for any reason including mistaken addresses on
mail or e-mail; technical, computer or telephone malfunctions or other
problems with computer on-line systems, servers, access providers, computer
equipment, or software; congestion on the internet or at any website, or any
combination of the foregoing;
(v) damage to any person’s
computer, including as a result of playing or downloading any material
relating to the Contest;
(vi) any delay or inability to act
resulting from an event or situation beyond their control, including a
strike, lockout or other labour dispute at their location or the locations of
the organizations and businesses whose services are used to administer the
HIGH GEAR MOTORCYCLE SERVICES LTD. contest;
(vii) any injury, damage or loss
arising from participation in the HIGH GEAR MOTORCYCLE SERVICES LTD. contest
or from the awarding, acceptance or use of any prize, or
(viii) prizes that are lost,
damaged or misdirected during shipping.
HIGH GEAR MOTORCYCLE SERVICES LTD. reserves the
right to cancel or suspend the HIGH GEAR MOTORCYCLE SERVICES LTD. contest
should a virus, bug, act of god, accident, or other cause beyond their
reasonable control corrupt the security or proper administration of the HIGH
GEAR MOTORCYCLE SERVICES LTD. contest. Any attempt to deliberately damage any
website or to undermine the legitimate operation of the HIGH GEAR MOTORCYCLE
SERVICES LTD. contest is a violation of criminal and civil laws. Should
such an attempt be made, HIGH GEAR MOTORCYCLE SERVICES LTD. reserves the
right to seek remedies and damages to the fullest extent permitted by law,
including criminal prosecution.
All personal information, such as name and contact
information, required to enter a HIGH GEAR MOTORCYCLE SERVICES LTD. contest
is collected by HIGH GEAR MOTORCYCLE SERVICES LTD. solely for the purposes of
administering the HIGH GEAR MOTORCYCLE SERVICES LTD. contest and will
not be used for any other purpose without your express consent. By providing
this information, you consent to it being used for the stated purposes.

SERVICES LTD. contest can be entered via a Third Party Service, you
understand that any personal information you share with such Third Party
Service may also be used on that Third Party Service and as set out in that
Third Party Service’s own privacy policy.
HIGH GEAR MOTORCYCLE SERVICES LTD. contests are
not sponsored, endorsed by or administered by Facebook, Twitter or any other
Third Party Service. By entering any HIGH GEAR MOTORCYCLE SERVICES LTD. contest,
all contestants release all Third Party Services from any liability in connection
with such HIGH GEAR MOTORCYCLE SERVICES LTD. contest.
If the identity of a contestant is disputed, the
authorized account holder of the e-mail address (or other social media)
submitted at the time of entry will be deemed to be the contestant. A selected
contestant may be required to provide proof that (s)he is the authorized
account holder associated with the selected entry.
All entries must be submitted from a valid e-mail
(or other social media) account that may be identified by reverse domain name
search. The sole determinant of time for the purposes of receipt of a valid
entry in the HIGH GEAR MOTORCYCLE SERVICES LTD. contest will be HIGH
GEAR MOTORCYCLE SERVICES LTD. HIGH GEAR MOTORCYCLE SERVICES LTD. reserves
the right to amend the Contest Rules or to terminate any HIGH GEAR MOTORCYCLE
SERVICES LTD. contest at any time without any liability to any contestant.
The decisions of HIGH GEAR MOTORCYCLE SERVICES LTD.
with respect to any dispute or issue involving a HIGH GEAR MOTORCYCLE
SERVICES LTD. contest are final and binding on all contestants.
